CENTENNIAL, Colo.--A judge in the James Holmes preliminary hearing allowed defense lawyers to call two witnesses to tesify on behalf of Holmes' mental state.
Despite objections made by the prosecution, two "lay witnesses" who don't want to be interviewed by defense investigators or identified by name can testify next week in the suspect's defense.
The suspect, James Holmes, is charged with killing 12 people and injuring 70 in an Aurora movie theater back in July.
Holmes faces multiple counts of murder and attempted murder.
According to authorities, next week's hearing is for the judge to determine whether prosecutors have enough evidence to go to trial.
