EL PASO COUNTY, COLO. -- El Paso County Sheriff's deputies are investigating a shooting in the 15000 block of North Ellicott Highway just north of Highway 24.

The call came in around 7:40 p.m. Saturday for a residential burglary in progress and then was updated to a shooting.

Deputies said a man and woman were inside the home when the 55-year-old burglar tried to force his way into their home.

When deputies arrived on scene, they found the alleged burglar with a gunshot wound to his abdomen.

Lt. Lari Sevene said the victim was taken to a hospital by helicopter where he later died.

A preliminary investigation revealed that the parties involved were not strangers. The woman who was at the home is the victim's ex-girlfriend.

No charges have been filed, and an investigation is ongoing.

Sevene said the "Make My Day Law," a Colorado law which allows homeowners or occupants to use deadly force against individuals who enter their home unlawfully, will be taken into consideration.

An autopsy will be scheduled early this week.
