COLORADO SPRINGS, COLO. -- There is new information on a shooting back in late October that landed a liquor store owner in jail.
Police said two men tried to steal an expensive bottle of vodka from a Colorado Springs liquor store, but the owner took the law into his own hands.
Now he faces attempted murder charges.
Police said 22 and 17-year-old men went into a liquor store on Austin Bluffs Parkway to steal a bottle of booze.
But they weren't counting on a liquor store owner who was armed and prepared to shoot.
The two men who were shot openly admit they came to the store on the night of Oct. 25 planning on stealing a expensive bottle of Grey Goose vodka, but as they ran out to get in their getaway car, the liquor store owner, 57-year-old Chang Ho Yi, came out with a gun.
Police said he shot into the car at close range.
"They went in there with the intent to shoplift, and as a result of that as they were leaving Mr. Yi came out of the store and fired a shot," Colorado Springs Police Sgt. Steve Noblitt said.
Police said the bullet shattered 22-year-old Bryson Dewberry's jaw and his 17-year-old accomplice was hit in the leg.
Dewberry told police he didn't realize he had been shot until he saw bone fragments laying in his lap.
Even though the two men had been shoplifting, it was the liquor store owner who was arrested for attempted murder.
"In a situation where you are essentially going to be taking another person's life or trying to take someone else's life, you have to be put in a position where there weren't any other alternatives," Noblitt said.
Police said Yi denied there had been a shooting, but when they patted him down he was still wearing a holster.
A search warrant turned up a .357 revolver hidden in a drawer in the liquor store.
Police said Yi went too far when he took the law into his own hands.
"Even in a home situation when someone has broken into your home, if they have come into your home and they grab your TV and they are on their way out the door we can't shoot him," Noblitt said.
Police said it will up to the District Attorney to decide if the two men will face shoplifting charges.
