Man convicted in 3 deaths at Colo. ice cream shop

CENTENNIAL, Colo. (AP) -- Jurors have convicted a man of vehicular homicide and other charges in a crash that killed three people, including a 3-year-old boy in a suburban Denver ice cream shop.

Twenty-five-year-old Francis Hernandez, an illegal immigrant from Guatemala, was convicted Tuesday.

Prosecutors say he was driving an SUV that crashed into a truck, which in turn crashed into a Baskin-Robbins store in September 2008. Two women in the truck were also killed.

Prosecutors say Hernandez ran a red light and was going more than 80 mph in a 40-mph zone.

Defense lawyers argue Hernandez' cousin was driving the SUV and that the driver of the truck shared the blame because she had methamphetamine in her system.

The cousin was later killed in a shooting.

CENTENNIAL, Colo. (AP) — Prosecutors told jurors in the trial of a man accused in a fatal crash at an ice cream store that they shouldn't be distracted by criticism of how police handled the investigation when they deliberate the case.

Arapahoe County prosecutors told jurors Monday during closing arguments that there is overwhelming evidence that 25-year-old Francis Hernandez was driving when his SUV crashed into a truck and sent it into an Aurora Baskin Robbins. The crash killed the two women in the truck and a 3-year-old boy in the store.

Hernandez's defense attorneys say his cousin was driving and that a police officer ignored a witness report that there were two people in the SUV. Prosecutors say Hernandez's DNA was on the driver's side air bag.

Deliberations began Monday afternoon.
