Fort Carson Burger King shooter found guilty

DENVER -- The Fort Carson resident who shot a Burger King employee before robbing the store on base in 2010 has been found guilty of that crime, as well as a shooting and robbery at a Cricket phone store just six weeks before that.

A jury in Denver convicted 22-year-old Joshua Smith Wednesday, more than two years after the crimes.

Smith shot a Cricket employee in the shoulder before robbing the South Nevada Avenue store Aug. 31, 2010. He shot a Burger King employee in the leg before robbing the fast food chain on base Oct. 11 of that year.

Investigators tracked the crimes to Smith and arrested him about five weeks after the Burker King robbery. He lived on base but was not a soldier

Smith faces between 35 and 55 years in prison. He will be sentenced Feb. 22.

“The defendant in this case used a deadly weapon during two robberies,” U.S. Attorney John Walsh said in a statement.  “Thanks to the trial team, and the FBI, Colorado Springs Police Department and Army Investigators, he faces decades in federal prison – and Colorado is a safer place.”

The jury deliberated the case for about a day and a half. Bianca Soto was found not guilty on similar charges related to the case.
