Amendment 64: Up in smoke

COLORADO SPRINGS, COLO. -- The legal issues are mounting after Colorado became the first state the legalize marijuana with Amendment 64.

The Colorado Attorney General and Gov. John Hickenlooper reaching out for guidance because no matter what voters want marijuana is still illegal under federal law.

"It's hard to imagine the chaos that would result if, state by state, you had one state legalizing it and one state not legalizing it," Gov. John Hickenlooper said.

Attorney General John Suthers even questioning whether the million dollars in funding the backers of the bill promised will actually happen.

"All this money that they're suggesting from a surtax is not going to be there maybe ever but at least for a couple of years," John Suthers said.

As for the comprehensive regulations, state lawmakers will have 13 months to put something on the books, when that happens the Office of the District Attorney, Fourth Judicial District said they will enforce the law.

But one thing the office will not support is the theory that legaized marijuana will help with crowded jails.

"The people that we see in prison and jails are usually folks that have committed violent offenses and done things like burglaries and robberies not a lot of first or second time drug offenders," "Jeff Lindsey, Chief Deputy District Attorney, of the Fourth Judicial District said.

But before the new stores can open in January 2014 lawmakers on the local, federal, and state level are looking over the fine print.

In a written statement from the Drug Enforcement Administration said, "The enforcement of the controlled Substances Act remains unchanged."

The statement goes on to say, "The Department of Justice is reviewing the ballot initiative."
