PUEBLO, Colo. (AP) -- Prosecutors in Pueblo have filed first-degree murder charges against a man accused of killing his 9-month-old cousin and dumping her body in the trash.

Twenty-two-year-old Kevin Neil Buehler appeared in court Monday but hasn't entered a plea. He also faces charges of fatal child abuse.

Iyana Perez's body was found July 3 in a trash bin behind a grocery store. Preliminary autopsy results suggested she died from a closed-head injury.

Police say her parents aren't suspects. The Pueblo Chieftain has reported the mother was in a drug rehab program at the time and the father was jailed on unrelated charges.

It's not clear whether the parents had left Iyana in Buehler's care.

Police say Buehler first told them Iyana died in bed and then said she was accidentally poisoned.
