EL PASO COUNTY, COLO. -- A 10-year-old arrested for possession of marijuana has the parents at Evans International Elementary shocked.
"It really makes me feel insecure about my daughter being here and I don't like it at all," Carlos Figueroa, an Evans International Elementary School parent said.
The El Paso County Sheriff's Office getting the call from Falcon School District 49 Tuesday morning, after the little girl showed the drug to a classmate.
Deputies then arrested the student, handcuffed her, and put her in the back of a patrol car.
"When you look at it legally from the legal stand point, once the child hits the age of 10 then in the state of Colorado they have reached the age of mental culpability or committing a crime and being charged with a crime," Jeff Kramer, of the El Paso County Sheriff's Office said.
The 10-year-old now facing a petty offense relating to marijuana for possession of less than an ounce.
District 49 said they can't comment on the child's disciplinary action but that they are following their drug-free policy that reads: "Students violating this policy shall be subject to disciplinary sanctions which may include suspension and or expulsion from school and referral for prosecution."
As for notifying the elementary school parents of Tuesday's arrest that has been reserved for those with students involved in the case.
"My son does go to school here so it would have been important for the parents to know what was going on," Isabel Sanchez, an Evans International Elementary School parent said.
The student's first court date is December 12th.
