Appeals court rules against pot dispensary

DENVER (AP) -- The Colorado Court of Appeals has rejected a claim by a marijuana dispensary that it should be allowed to remain in business despite limits imposed by Jefferson County zoning officials.

The court ruled Thursday that the owners of Footprints Health and Wellness, Inc., did not qualify for protection under Colorado law that allows marijuana dispensaries because the law also allows local communities to set their own standards.

The providers opened a dispensary in a Jefferson County shopping center in 2009, and two months later were served with a zoning violation notice.

An attorney for the company could not be reached for comment.
