Identity released of cadet accused of sexual misconduct

The name of the Air Force Academy cadet accused of sexual misconduct is being released.

He was identified on Friday as Cadet 1st Class Benjamin York.

It was earlier this year when the investigation was launched by an independent officer, prompted by a decision from Commandment.

The cadet’s name was not initially released but because of Commandment’s decision, his name is being released based on the "balancing test." That test is required by the Freedom of Information Act.

Academy officials said the decision made by Commandment is similar to what a civilian grand jury is except that it will be open to the public.

"At this time, charges are merely accusations," officials said in a news release. "The accused in each case is presumed innocent until and unless proven guilty."
