U.S. AIR FORCE ACADEMY, COLO. -- A hearing is scheduled for the Air Force Academy cadet accused of sexual misconduct.
The hearing, an Article 32 hearing, is set for Thursday, Academy officials said.
Cadet 1st Class Benjamin York was charged with aggravated sexual assault on Jan. 31.
Similar to a civilian grand jury, an Article 32 hearing decides whether or not the case moves forward.
"It must be emphasized that charges are merely accusations, and the accused is presumed innocent until and unless proven guilty," officials said in a news release.
It was last week when York was identified by Academy officials. The cadet’s name was not initially released but because of Commandment’s decision, his name is being released based on the "balancing test." That test is required by the Freedom of Information Act.
