Suspect who killed man with rock justified

COLORADO SPRINGS, COLO. -- The man who killed another by throwing a rock at him outside a sports bar in November will not face charges, according to the District Attorney.

On Nov. 26, 27-year-old William "Josh" Landrum was hit in the head with a rock outside Hondo's Sports Bar in the 4600 block of Centennial Boulevard in Colorado Springs following a disturbance in the parking lot as the bar was closing. He died later that morning at Penrose Hospital.

Police investigation revealed the suspect, Nicholas Blunt, threw the rock in self-defense.

According to investigators, several verbal fights broke out in the parking lot as the bar was closing. Witnesses said Blunt, Landrum and others were involved in one of them, but they said Blunt did not initiate anything.

Blunt began to run away and was chased by Landrum and about 10-11 others. When Blunt saw them picking up rocks from a decorative planter in the parking lot, he too picked up a rock and threw it toward Landrum before continuing to run.

Physical evidence at the scene and witnesses support Blunt's statement that he wasn't trying to kill anybody. Officers also said others were uncooperative in the investigation but Blunt remained cooperative throughout.

Reports also showed Landrum's blood-alcohol content was twice the legal driving limit, while Blunt had not been drinking that night.

Under Colorado’s self-defense statute and established case law, an individual may use physical force upon another person to defend himself and may use the degree of force that he reasonably believes to be necessary for that purpose.  An individual may act upon reasonable appearances, including the number of persons appearing to be threatening such individual.
