Police make arrest in fatal July 12 shooting

COLORADO SPRINGS, COLO. -- Colorado Springs Police officers have arrested a man allegedly responsible for the shooting death July 12 in the city. They questioned but did not arrest him originally.

Officers arrested 53-year-old Gary Albert Ybanez Friday for shooting 35-year-old Franklin Ybanez to death around 12:30 a.m.

Police responded to a disturbance in the 4900 block of Hackamore Drive South and found Franklin's body in front of a house. They said there was a domestic disturbance prior to the shooting.

At least 12 nearby residents said they heard the shots that morning.

Officers interviewed Gary but did not originally arrest him. Gary is now being charged with second degree murder.

Sourced said Franklin was Gary's stepson.
