COLORADO SPRINGS, COLO. -- A jury found former Fort Carson soldier Frank Miller guilty Friday of first and second degree murder in connection with the shooting death of 26-year-old Christopher Harmon outside a Wal Mart Sept. 26.
The drive-by shooting happened early on a Sunday morning at the Wal Mart in the 3200 block of East Platte Avenue in Colorado Springs. Police said Miller and 17-year-old Jordan Ellis were in a car when it drove across a parking lot and in front of the building. Harmon was shot and killed, and the car fled.
Colorado Springs Police arrested Miller Oct. 5, crediting witnesses and surveillance video as key players in helping identify Miller as the suspect.
Miller is a former soldier who was stationed at the Mountain Post. He was originally charged with first degree murder, but was found guilty of both first and second degree murder by the second jury to hear the case.
The original trial was thrown out after attorneys mistakenly showed a piece of evidence to the first jury.
Miller was sentenced to life in prison without parole.
