GREELEY, Colo. (AP) -- Weld County District Attorney Ken Buck says he will not file charges against officers who fatally shot a 60-year-old man outside an Evans truck stop last month.

Authorities say SWAT team officers killed Kenneth Yeager after he pointed a gun at them while they tried to talk him out of his car in the parking lot of a restaurant from which he had been thrown out earlier. Police say Yeager was asked to leave the restaurant after he got angry about how his eggs were cooked.

Authorities say they later responded to the restaurant after a report that someone had fired two shots there. Yeager was in his car when officers arrived.

Buck said Wednesday officers were justified in shooting because they were protecting themselves from a potentially dangerous situation.
