Judge to decide fate of Windsor pot dispensary

WINDSOR, Colo. (AP) — A judge is considering whether a medical marijuana dispensary that Windsor town officials say is defying a moratorium on the businesses should be shut down.

Weld County District Judge James Hartmann heard testimony on the dispute Thursday. He says it will be at least a week before he rules.

Windsor is seeking an injunction to close the MediGrow dispensary. The town has been citing owner Lazarus Pino every day since Dec. 17, a day after it passed a 75-day moratorium on new marijuana dispensaries.

Pino says he opened for business before the moratorium was approved and was left off the list of businesses allowed to keep operating. His attorney argued that the moratorium is unconstitutional.
