2 arrested for drug and weapons possession

COLORADO SPRINGS, COLO. -- Colorado Springs Police Department arrested two men on Monday afternoon after one sold a quantity of marijuana to an undercover detective at the Conoco Gas Station, 800 N. Nevada Ave. and the second man resisted arrest.

Joseph Upshaw, 21, arrested in the drug sale, was also in possession of a loaded Smith & Wesson semi-automatic handgun when arrested.

Detectives executed a search warrant at Upshaw's residence, 1408 N. Weber St.

Police found a man identified as Justin McDowell, 22, when they entered Upshaw's bedroom. McDowell resisted arrest and was taken into custody on an active warrant for attempted first-degree murder. He was in possession of a 9 mm Ruger handgun, found under the cushion on the sofa bed where he was sleeping.

During the search of Upshaw's bedroom, police found a third handgun, identified as a Hi-Point 9mm handgun, 11 pounds of marihuana, 27 grams of mushrooms and $600 in cash.

Upshaw was arrested for distribution of marijuana and carrying a concealed weapon and booked into the Criminal Justice Center.

McDowell was booked on the active warrant for attempted murder and resisting arrest.

The attempted murder occurred on an unnamed date in the area of Astrozon Boulevard and Middleton Court.
