Colo. Supreme Court won't review rape case

DENVER (AP) — The state Supreme Court declined to review a lower court's ruling saying a Colorado district attorney acted properly in refusing to take the case of a woman who claimed she was raped.

The decision Monday means the Court of Appeals ruling last year will stand. That ruling said prosecutors have discretion to decide whether to file charges.

Julie Stene alleges that she was raped during a high school graduation party in 2000 by two classmates, including one who was later tied to a sex scandal at the University of Colorado. Stene has agreed to have her name used publicly.

Stene initially didn't want to testify and no charges were filed. She changed her mind in 2004 but the Arapahoe County District Attorney's Office said it couldn't prove her case.
