MONTROSE, Colo. (AP) -- Colorado investigators say Montrose police who entered the garage of a man who shot an killed an officer during a domestic violence call in July believed that the suspect was unarmed.

The Colorado Bureau of Investigation says in a report of the shooting released Monday that the officers also had probable cause to arrest 52-year-old Dennis Gurney. Police say Gurney killed himself with a gun after fatally shooting Sgt. David Kinterknecht.

Gurney also wounded two other responding officers.

CBI says in its report that the officers decided to enter Gurney's garage because it appeared he didn't have access to weapons.

CBI says no charges will be filed in the case.
