US prosecutors back charges on accused fake lawyer

DENVER (AP) — Federal prosecutors say a man convicted in North Dakota for impersonating an lawyer isn't facing double jeopardy despite a similar case in Colorado.

Prosecutors argue in documents filed Monday in U.S. District Court in Denver that the charges Howard Kieffer faces in Colorado rely on different facts than the case in North Dakota, where he was convicted of mail fraud and making false statements.

Kieffer is appealing the convictions, and he contends the charges filed in Denver should be dismissed.

Federal prosecutors say he served as a lawyer in federal court in Denver despite never graduating from law school.

A trial preparation conference is scheduled Friday.
