Accused 'phony lawyer' seeks dismissal of charges

DENVER (AP) -- A man convicted in North Dakota for impersonating an lawyer says he shouldn't have to face similar charges in Colorado.

Howard Kieffer's lawyer Nathan Chambers filed a motion Monday in U.S. District Court in Denver asking a judge to dismiss charges filed in Denver. He argues that the Fifth Amendment protects against double jeopardy.

Federal prosecutors say Kieffer served as a lawyer in federal court in Denver despite never graduating from law school.

One of his clients, Gwen Bergman, was convicted last year of trying to hire someone to kill her son's father, but she is appealing based on Kieffer's conviction in North Dakota on charges of mail fraud and making false statements.

Kieffer is appealing his convictions.
