Developmentally disabled man convicted of rape

GREELEY, Colo. (AP) — A Greeley man has been convicted of sexual assault for a second time after his first conviction was thrown out because his lawyers weren't allowed to tell jurors he is developmentally disabled.

Thirty-eight-year-old Larry Flippo was found guilty on Friday of attacking a woman in 2001.

He was convicted in 2002 and sentenced to eight years to life in prison, but that was overturned in 2005.

Flippo could be given probation or returned to prison at his Jan. 21 sentencing.

Defense attorney Shannon Lyons argued that Flippo may not have understood the woman didn't want to have sex.

Prosecutor Rick Wetmore argued that Flippo was capable of comprehending the woman's wishes.
