MySpace post won't be in soldier's murder trial

COLORADO SPRINGS, Colo. (AP) -- A disturbing MySpace posting left by a Fort Carson soldier won't be used in his upcoming double murder trial.

Iraq War veteran Jomar Falu-Vives is accused of opening fire with an AK-47 and killing a man and a woman posting a garage-sale sign last year. The 24-year-old's MySpace page read, "Reading is for the lame. Go shoot someone."

Falu-Vives also faces attempted murder charges in the drive-by shooting last spring of another Fort Carson soldier. That soldier, Capt. Zachary Szody, was shot twice but survived.

Falu-Vives' lawyer argued the MySpace posting should not be used in trial. District Judge Thomas Kennedy agreed Tuesday. Falu-Vives has pleaded not guilty and faces trial in both shootings in October.
