Bucklen Equipment Co. Inc. was accused of depositing dredged and fill material along 1,400 feet of the river without authorization. The U.S. Environmental Protection Agency said Tuesday that the company agreed to the penalty and to remove any remaining gravel piles from wetlands along the river.

It was the third major asphalt spill in recent weeks in Colorado. Last month, two asphalt trucks overturned and spilled asphalt into the Poudre River.

Sheriff's spokeswoman Eloise Campanella says about 5,000 gallons of asphalt spilled into the river. That's roughly the same amount that spilled last week four miles upstream in the earlier crash.

The Larimer County Sheriff's office says witnesses reported seeing a motorcyclist crash and go under a guardrail into the river Wednesday afternoon. Crews searched until nightfall and continued searching Thursday but have not found the man witnesses say went into the river.
